Terms of Service for Painter Promotions Effective Date: Mar 10th, 2026

These Terms of Service ("Terms") govern your access to and use of our services at Painter Promotions. By accessing or using our services, you agree to be bound by these Terms and acknowledge the receipt of our services outlined below.

1. Services Provided Painter Promotions agrees to provide the following services: Set up and management of appointment setting services on agreed platforms. Provision of customized follow-up software. Organization and management of leads. Customer support during normal business hours (9 AM – 5 PM MDT).

These services are inclusive of those agreed upon at the date of signing the contract. Any additional services offered by Painter Promotions in the future will be optional and may incur additional fees, subject to the Client's agreement.

2. SMS Communications & Use Cases By providing your phone number and opting in, you consent to receive SMS messages from Painter Promotions. These messages may include: appointment reminders and confirmations, follow-up messages related to leads and scheduling, promotional offers and service updates, and customer support communications. Message frequency may vary depending on your activity and the services you use.

Message & data rates may apply. Your carrier's standard messaging and data rates apply to all SMS messages sent and received. Painter Promotions is not responsible for any charges from your wireless provider.

Opt-Out Instructions: You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message, and no further SMS messages will be sent unless you re-subscribe. You may also contact us directly to request removal.

Carrier Liability Disclaimer: Painter Promotions and mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and network availability. Neither Painter Promotions nor any wireless carrier shall be held responsible for any loss, injury, or damages resulting from SMS messages sent or received.

3. Age Restriction You must be at least 18 years of age to use our services or to consent to receiving SMS communications from Painter Promotions. By agreeing to these Terms, you confirm that you are 18 years of age or older.

4. Client Responsibilities The Client agrees to: Pay for advertising at the beginning of each billing period. Actively manage their calendar and update tracking sheets weekly.

5. Subscription Fee & Trial Period The Client agrees to pay the cost before any services begin. The Client will be automatically enrolled in a monthly subscription at $1,500 USD unless canceled per the cancellation policy outlined in these Terms. Payments made via credit card are subject to a 3% processing fee.

6. Payment Failure In case of payment failure, the Client must provide a new payment method within 48 hours. A 15% penalty will be charged on the outstanding balance monthly until full payment is received. Services may be suspended during periods of non-payment.

7. Cancellation Clients may cancel their subscription at any time via written notice at least 7 business days prior to the monthly renewal date. Upon cancellation, access to software and services will terminate at the end of the current billing period. All customer data and advertising assets remain the property of Painter Promotions post-cancellation. Clients may choose to purchase data and training materials for a one-time fee.

8. Dispute Resolution / Arbitration Any disputes arising under these Terms will be resolved through arbitration in accordance with the American Arbitration Association, located in Provo, Utah, and conducted in English.

9. Governing Law These Terms are governed by the laws of the State of Utah.

10. Modifications Painter Promotions reserves the right to modify these Terms at any time. Continued use of our services after such changes will constitute your consent to such changes.
