Terms of Service for Painter Promotions

These Terms of Service ("Terms") govern your access to and use of the services provided by Painter Promotions LLC ("Painter Promotions," "we," "us," or "our"). By accessing or using our services, or by opting in to our SMS program, you agree to be bound by these Terms.

1. Services Provided

Painter Promotions agrees to provide the following services:

Set up and management of appointment setting services on agreed platforms

Provision of customized follow-up software

Organization and management of leads

Customer support during normal business hours (9:00 AM – 5:00 PM MT)

These services are inclusive of those agreed upon at the date of signing the contract. Any additional services offered by Painter Promotions in the future will be optional and may incur additional fees, subject to the Client's agreement.

2. SMS Messaging Program

Program description. Painter Promotions operates a customer care SMS program. By providing your mobile phone number and opting in, you consent to receive text messages from Painter Promotions at that number. Messages may include confirmations of calls or appointments you have scheduled with us, appointment reminders, rescheduling messages, follow-up regarding an inquiry you submitted, and replies to questions you send us.

How to opt in. You may opt in by checking the SMS consent box on a form on our website, by replying with a keyword such as YES to a message from us, or by providing verbal consent during a call with us.

Consent is not a condition of purchase. Agreeing to receive SMS messages is not required in order to purchase any goods or services from us.

Message frequency. Message frequency varies depending on your activity and the services you use.

Message and data rates may apply. Your carrier's standard messaging and data rates apply to all SMS messages sent and received. Painter Promotions is not responsible for any charges from your wireless provider.

Opt-out instructions. You may opt out at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and no further SMS messages will be sent unless you re-subscribe. You may also contact us directly to request removal.

Help instructions. Reply HELP to any message for assistance, or contact us at [email protected] or 385-412-9827.

Carrier liability disclaimer. Painter Promotions and mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier and network availability. Neither Painter Promotions nor any wireless carrier shall be held responsible for any loss, injury, or damages resulting from SMS messages sent or received.

Privacy. Information collected through our SMS program is handled in accordance with our Privacy Policy at https://painterpromotions.com/privacy-policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

3. Age Restriction

You must be at least 18 years of age to use our services or to consent to receive SMS communications from Painter Promotions. By agreeing to these Terms, you confirm that you are 18 years of age or older.

4. Client Responsibilities

The Client agrees to:

Pay for advertising at the beginning of each billing period

Actively manage their calendar and update tracking sheets weekly

5. Subscription Fee

The Client agrees to pay the cost before any services begin. The Client will be automatically enrolled in a monthly subscription at $1,500 USD unless canceled per the cancellation policy outlined in these Terms. Payments made via credit card are subject to a 3% processing fee.

6. Payment Failure

In case of payment failure, the Client must provide a new payment method within 48 hours. A 15% penalty will be charged on the outstanding balance monthly until full payment is received. Services may be suspended during periods of non-payment.

7. Cancellation

Clients may cancel their subscription at any time via written notice at least 7 business days prior to the monthly renewal date. Upon cancellation, access to software and services will terminate at the end of the current billing period. All customer data and advertising assets remain the property of Painter Promotions post-cancellation. Clients may choose to purchase data and training materials for a one-time fee.

8. Dispute Resolution / Arbitration

Any disputes arising under these Terms will be resolved through arbitration in accordance with the American Arbitration Association, located in Provo, Utah, and conducted in English.

9. Governing Law

These Terms are governed by the laws of the State of Utah.

10. Modifications

Painter Promotions reserves the right to modify these Terms at any time. Continued use of our services after such changes will constitute your consent to such changes.
